Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you ("you", "your", or "Customer") and Nguyen Thanh Duc, a sole proprietor based in Hanoi, Vietnam ("we", "us", "Mostify"), governing your access to and use of the Mostify website (wpmostify.com), the Mostify Pro WordPress plugin, and related services (collectively, the "Services").

By creating an account, purchasing a subscription, or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. Description of the Service

Mostify provides a WordPress plugin for tracking and displaying popular posts based on page views, comments, ratings, shares, likes, and custom actions. The Service includes:

To purchase a Pro subscription, you must create an account with a valid email address and password. You are responsible for:

3. Subscription, Billing, and Payment

3.1 Subscription plans

We offer three tiers (Single, Developer, Unlimited) each available in monthly or yearly billing intervals. Current pricing is shown on /pricing.

3.2 Payment processing

Payments are processed by Gumroad, our third-party payment provider. By purchasing, you also agree to Gumroad's Terms of Service.

3.3 Recurring billing

Subscriptions are recurring. Your card will be charged automatically at the end of each billing period (monthly or yearly) until you cancel.

3.4 Price changes

We may change subscription prices. Existing subscriptions continue at their current price until renewal; price changes apply only at the next renewal cycle and we will notify you at least 30 days in advance.

3.5 Taxes

Prices shown do not include taxes. You are responsible for any applicable VAT, sales tax, or other taxes in your jurisdiction. Gumroad calculates and collects these as required.

4. Cancellation and Refunds

You may cancel your subscription at any time from your account dashboard or through your Gumroad account. After cancellation:

You acknowledge that you receive immediate access to digital goods upon purchase, and you waive any right to refund.

4.3 EU consumer right of withdrawal — Article 16(m)

If you reside in the European Union, EU Directive 2011/83/EU normally grants a 14-day right of withdrawal for digital goods. By purchasing, you expressly consent that performance of the contract begins immediately upon delivery of your license code, and you expressly acknowledge that you lose your right of withdrawal under Article 16(m) of the Directive.

4.4 Statutory rights

This no-refund policy does not affect any non-waivable statutory rights you may have under applicable consumer protection law in your jurisdiction.

5. License Grant

5.1 Plugin source code (GPL-2.0+)

The Mostify Pro plugin source code is licensed under the GNU General Public License version 2.0 or later (GPL-2.0+). You may use, modify, and redistribute the source code subject to the GPL.

5.2 License code (proprietary)

Your license code, however, is a contractual right separate from the GPL — it grants you:

Each domain registration requires explicit approval through your dashboard before Pro features unlock on that domain. By purchasing, you agree to this process.

6. Acceptable Use

You agree NOT to use the Services to:

  1. Unauthorized tracking of personally identifiable information (PII). The plugin tracks anonymous engagement metrics. Using it to deanonymize visitors, build personally identifiable profiles, or correlate visitor data with PII without proper consent and disclosure to those visitors violates these Terms and applicable privacy laws (including GDPR, CCPA, and Vietnam's Personal Data Protection Decree).
  2. Resell or redistribute license codes, even if you obtained them legitimately.
  3. Reverse-engineer the license server, mimic its API, or attempt to bypass domain approval.
  4. Use on illegal content sites, including but not limited to: child sexual abuse material (CSAM), copyright-infringing content, sites that promote violence or terrorism, or sites that violate sanctions.
  5. Abuse our infrastructure: rate-limit-bypassing, DDoS, or any activity that interferes with normal Service operation.
  6. Misrepresent your identity during signup, payment, or support interactions.
  7. Initiate fraudulent payment disputes — see Section 7.2 below.

Violations may result in immediate account suspension or termination without refund, and report to relevant authorities.

7. Termination

7.1 Termination by you

You may terminate your account at any time by canceling your subscription and emailing us to delete your data.

7.2 Termination by us

We may suspend or terminate your account immediately, without notice or refund, if:

Upon termination, your right to use the Services ceases. Tracking data already on your WordPress site remains there (it is your data, on your server).

8. Intellectual Property

All Mostify branding, logos, marketing copy, and the wpmostify.com website are owned by Nguyen Thanh Duc. You may not use them without written permission.

The plugin source code is GPL-licensed (Section 5.1).

You retain all rights to content on YOUR WordPress site. We claim no ownership over your tracking data, content, or settings.

9. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR PERFORMANCE.

We do not warrant that:

You use the Services at your own risk.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICES, REGARDLESS OF CAUSE OF ACTION, SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

You agree to indemnify, defend, and hold harmless Nguyen Thanh Duc from any claims, damages, costs, and expenses (including reasonable legal fees) arising from:

We may modify these Terms at any time. Material changes will be communicated via email or website notice at least 14 days in advance. Continued use of the Services after changes take effect constitutes acceptance.

If you do not agree to modified Terms, you must stop using the Services and may cancel your subscription.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Socialist Republic of Vietnam, without regard to conflict-of-law principles.

Any dispute arising from or related to these Terms shall first be resolved through good-faith negotiation. If unresolved within 60 days, the dispute shall be submitted to the competent courts of Hanoi, Vietnam, which shall have exclusive jurisdiction.

For consumers in jurisdictions where mandatory consumer protection law grants additional rights or different forums, those rights and forums apply notwithstanding this section.

14. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Services and supersede any prior agreements.
